Submission of online advertising whether banner, buttons or text ads constitutes
your acceptance of the following Terms and Conditions:
Terms of Payment:
Prepayment payable by Visa, Mastercard upon completion of the Advertising Order form
and paid in US funds only. (Your credit card Number is encypted
in our secure servers during transmission) We also accept checks and Money
Order subject to clearing before publication..
Submission of Advertising Materials:
Upon confirmation, you may forward
all your banner creatives and/or text ads for
inclusion to the PowerHomebiz.com website and placement shall commence three
working days or earlier. after receipt thereof.
The advertiser may suggest to make changes on the banners and texts to
ensure optimum response provided sufficient time of at least five
working days is given to
PowerHomeBiz.com to implement the changes.
No Guarantee:
PowerHomebiz.com makes no guarantee
regarding the level of impressions of or clicks on any Ad, the timing of
delivery of such impressions and/or clicks, or the amount of sales to be made by
you under this Agreement.
Restrictions.
PowerHomebiz.com reserves the right to accept or not to accept any
advertising that it deems unfit or unrelated to its publication theme. Only Business related commercial advertisement will be accepted. We
cannot accept the following: Get rich quick schemes, gambling, adult
erotica, and those with exaggerated or misleading claims.
Orders declined will not be processed.
Non-Cancellation-non Refundable Policy:
All advertising orders are not
cancelable and payments NON-REFUNDABLE.
Statement of
Liability.
PowerHomeBiz.com shall not be liable for any damages that may result from
power outages, or any "force majeure" or events caused by an act
of God, technological failures which may affect the powerhomebiz.com web
site or any event beyond its reasonable control. However, powerhomebiz.com
guarantees to deliver the contracted impressions or advertising placements
as ordered with no specific contract terms and shall continue to run the ad
until the order has been fulfilled. UNDER NO CIRCUMSTANCES SHALL
POWERHOMEBIZ.COM BE LIABLE TO THE ADVERTISER OR AGENCY FOR INDIRECT,
CONSEQUENTIAL OR PUNITIVE DAMAGES OR LOST PROFITS OR LOSS OF GOODWILL,
REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH ANY SUCH CLAIM MAY BE
BASED.
By submitting an advertising order, you agree to be bound by these terms
and conditions which shall be governed and interpreted solely in accordance
with laws of the State of Virginia, U.S.A. and the Federal laws of the
United States (if applicable) You further agree that any dispute or claim
concerning advertising submitted hereunder shall be exclusively litigated in
a court having competent jurisdiction in Fairfax County, Virginia, USA,
which you agree shall have personal jurisdiction over you.
